CUSTOMER POLICY:
VISTAKON®, DIVISION OF JOHNSON & JOHNSON VISION CARE, INC.

The VISTAKON® Customer Policy is designed to promote patient health through the responsible and safe distribution of its contact lenses. VISTAKON® Products will only be sold through Qualified Professionals and Retailers that sell only to end-users based on a valid prescription, in compliance with all applicable laws and regulations regarding the sale and dispensing of contact lenses and the VISTAKON® Diagnostic Lens Policy set forth below.

 

VISTAKON® does not ship its Products with labeling materials that permit them to be sold over the counter. Therefore, all Qualified Professionals or Retailers, prior to delivery or shipment of the lenses to the consumer, must comply with all federal and state laws and statutory regulations regarding the sale or furnishing of contact lenses, including prescription verification laws.

 

The VISTAKON® Diagnostic Lens Policy

Diagnostic Lenses are only intended for trial fitting of appropriate candidates, or for the occasional replacement of torn or lost lenses. Qualified Professionals and Retailers may not (a) sell Diagnostic Lenses, (b) substitute Diagnostic Lenses for Revenue Lenses, or (c) give Diagnostic Lenses away at no charge as Product promotions for replacement contact lens sales.

 

Qualified Professionals and Retailers may purchase only from authorized U.S. suppliers.

 

Qualified Professionals and Retailers must use VISTAKON® Trademarks and Brands in a manner consistent with Johnson & Johnson Vision Care, Inc., policies.

 

Qualified Professionals and Retailers shall not make false or misleading statements about VISTAKON®, its business practices or any of its Products.

 

Qualified Professionals and Retailers must comply with all label licenses or use restrictions on which VISTAKON® may condition the purchase or receipt of any Products.

 

Qualified Professionals and Retailers with direct accounts must keep their account balances with VISTAKON® in good standing.

 

VISTAKON® reserves the right to commission annual audits of Qualified Professionals and Retailers to assess compliance with legal obligations, diagnostic lens policy, and any territorial restrictions. VISTAKON® reserves the right to terminate a Qualified Professional or Retail Account that violates this Policy. Termination does not release or forgive the Account from the obligation to pay any sum owed to VISTAKON®.

PURCHASING BY CREDIT CARD:
If you choose, you can purchase your orders using either your VISA or MasterCard. Your account must be enrolled in the Customer First™ Credit Card Program before credit card orders can be accepted. Once you’re enrolled, just identify that you wish to use your MasterCard or VISA when you call to place an order. Your credit card will be billed when product is shipped. Because credit cards may be used for ordering only, outstanding balances may not be transferred from your VISTAKON® account to your credit card. Please Note: VISTAKON® is not acting as a credit issuer. This enrollment is merely to enable your account to purchase VISTAKON® Products utilizing VISA or MasterCard. The enrollment information is for the sole purpose of enrolling your account in the VISTAKON® Credit Card Program. Your signature warrants that the information given is true and correct. VISTAKON® reserves the right to terminate the use of the program at any time.

 

ORDERING REQUIREMENTS:

  • No minimum order required.
  • Orders of four (4) or more revenue multipacks, will be shipped free of charge.
  • Orders less than four (4) multipacks will incur a shipping charge of $5.95 per order.
  • Any combination of revenue product, regardless of brand can be combined to achieve the minimum ordering requirements.

 

RETURN POLICY:
VISTAKON®, DIVISION OF JOHNSON & JOHNSON VISION CARE, INC.
VISTAKON® will accept and credit returned product provided VISTAKON® receives product in its original and unopened package. The multipacks must be free of stickers, marks, or any other type of package alteration. Credit will not be issued for any product received beyond the product expiration date or for single lens blisters. All product received that does not meet the criteria for credit will be destroyed.

 

In the event that a VISTAKON® multipack is damaged in transit or an incorrect quantity or parameter is shipped to the customer, VISTAKON® will issue an exchange for the incorrect product and facilitate replacement of the damaged product.

 

To return product, use the VISTAKON® Return Form (all customers must indicate a reason for returning product). You can download a copy of the form at www.ecp.acuvue.com or contact Customer Service at 1-800-874-5278 for a faxed copy. VISTAKON® will, upon receipt and inspection of the returned goods, issue a credit. Credit will be given based on the original purchase price of the product.

TERMS AND CONDITIONS OF SALE:
Current and past due amounts, reflected on the statement as

POLICY CHANGES:
WARRANTY:

All VISTAKON® lenses are warranted against defects in materials and workmanship. If, after opening a factory-sealed blister pack, the lens is found to have a material or workmanship problem. VISTAKON® will replace the lens.

Except for the expressed warranty stated above, VISTAKON® disclaims all warranties, expressed or implied, including any implied warranty of merchantability or fitness for a particular purpose. The expressed warranty and remedy provided are exclusive and in lieu of all other warranties and remedies by law.

 

LIMITATIONS:
The above warranty and remedy extend only to the original purchasers from VISTAKON® and VISTAKON® expressly denies the right of any other party to incur or assume on behalf of VISTAKON® for special, incidental or consequential damages arising from breach of warranty, breach of contract or any other legal theory; including, but not limited to, damages resulting from loss of profits or revenue, business injury, costs of substitute Products or claims of customers.
